Answers To Frequently Asked Questions

The short answer is that it depends. The Consumer Protection Act, 2002 provides that services supplied must be of a reasonably acceptable quality. What exactly constitutes a “reasonably acceptable quality” is for a judge to decide. Generally speaking, if your contractor has not done work to code or the work is clearly deficient, you may sue for damages.

Small Claims Court in Ontario can help you recover money or property from a Defendant, up to a limit of $35,000.

This means that if you want to sue someone for more than $35,000, you will have to bring your claim in Superior Court not Small Claims Court.

A common situation that clients come to us with is where they have hired a contractor and the contractor has done some work, but now the relationship has deteriorated (perhaps the work was done poorly or perhaps it is taking much longer than initially quoted). The home owner decides to stop paying the contractor and to use someone else, and now the contractor says that they will place a construction lien on their property.

A construction lien is serious and effectively prevents you from selling your property or refinancing it. If a contractor has threatened to put a lien on your property, you should schedule a consultation with a lawyer immediately to discuss your options. You can reach us at (437) 222-2234.

Generally speaking, the limitation period (the amount of time you have to start a lawsuit) is 2 years from the date that you knew or ought to have known that you have a cause of action (a reason to sue) against a contractor.

If you wait longer than that, you run the risk of being “statute barred”, meaning your case will be thrown out.

At Last A Law Firm With the Expertise You Need

At a Price You Can Afford

Do you want to know a secret about why large law firms in Toronto are so outrageously expensive? Well, for starters, they have massive overhead. Their offices are in the financial district which has the highest commercial rents in the entire province. Do you benefit at all from them having those really nice offices? Nope. Not at all. Lawyers argue their cases at court, not at their offices, so it doesn’t matter whether their offices are in overpriced steel and glass towers downtown or in a nice professional building in North York like us.

We are a young legal team, yet we have more courtroom experience than most lawyers who have been practising for decades. At the end of the day, what matters is the experience and skill that your lawyer brings to the table. What you really need is a lawyer who is as comfortable in the courtroom as they are in their own living room. The only way to get that level of comfort is by going to court. A lot. And that is exactly what you can expect from your Toronto civil litigation lawyer at Powell Litigation.

You’ll be shocked by this. At a recent trial, I was facing off against a lawyer who has literally been practising law since I was born. He did a fine job (although we ended up winning the trial and getting $170,117.84 for our client. You can read the decision here). What was shocking was that this lawyer confided in me that, after decades of practising law, this was his very first trial! Can you imagine that?

To get a lawyer with the courtroom experience you need to win your case, call us today at (437) 222-2234.
